Transport Law

transport lawyer

Inmar Legal has more than 25 years of experience providing comprehensive legal support to transport-logistics companies. We have a deep understanding of the industry’s specifics, including sea, road, and rail cargo transportation. In every transport-related matter, a qualified transport lawyer with industry knowledge, litigation experience and an understanding of international transportation standards is engaged.

Our specialists help minimize risks, optimize business processes and effectively resolve disputes, ensuring business stability and development in the dynamic logistics environment. Our goal is not simply to solve the problem, but to prevent future risks through strategic planning and preventive measures.

Services

The transport law team at Inmar Legal provides comprehensive legal support to logistics operators, cargo owners, freight forwarders, and carriers at every stage of the transportation process. Each matter is led by an experienced transport lawyer with deep industry knowledge and a practical understanding of commercial logistics, regulatory frameworks, and cross-border supply chains.

Consultations on Legal Aspects of Cargo Transportation

We advise clients on all contractual aspects of cargo transportation, including drafting and negotiating carriage and freight forwarding agreements, allocating risks between parties, and ensuring compliance with applicable transport law and international conventions. Our work frequently involves complex multimodal structures where a transport lawyer must coordinate legal regimes across jurisdictions while maintaining commercial efficiency.

Disputes with Carriers

A significant portion of our practice involves preventing and resolving disputes with carriers. We represent clients in matters relating to cargo loss or damage, delivery delays, tariff disputes, and unlawful retention of goods. Our lawyers conduct detailed factual investigations, engage technical and industry experts where necessary, and build litigation strategies that protect both the legal and commercial interests of clients operating in time-sensitive logistics environments.

Disputes with Insurers

We also act in disputes with insurers, including cases involving cargo insurance, carrier liability coverage, and terminal operator liability policies. A transport lawyer from our team analyzes policy wording, establishes the true cause of loss, and challenges unjustified denials of indemnity, ensuring that insurance mechanisms function as an effective risk-management tool rather than a source of additional conflict.

Regulatory & Operational Transport Law Advisory

Beyond dispute resolution, our transport law practice provides ongoing regulatory and operational support. We advise freight forwarders and carriers on compliance with licensing, safety, and documentation requirements, as well as on structuring internal procedures to reduce exposure to liability. Particular attention is given to the evolving regulation of electronic transport documents and digital workflows, where a transport lawyer ensures legal validity and evidentiary reliability.

Support for Freight Forwarders and Carriers

In the field of freight forwarding, we help clients structure legally robust operational models, clearly define the scope of responsibility between forwarders and carriers, and minimize the risk of requalification of contracts. Our lawyers regularly assist in aligning contractual frameworks with actual logistics practices to prevent future disputes with carriers and counterparties.

Legal Support of Information Security

Our services further include legal support for information security within transport and freight forwarding activities. Following recent legislative amendments introducing new requirements for electronic document circulation and personal data localization, our transport lawyers develop internal compliance policies, adapt contractual clauses on data processing, and ensure that clients’ operations meet the standards of information protection and data regulation.

Litigation & Dispute Resolution

Where conflicts escalate, the same transport lawyer who advised on structuring the transaction remains involved in the dispute phase, ensuring continuity of strategy. This integrated approach — combining advisory work, risk prevention, and representation in disputes with carriers and disputes with insurers — allows our clients to operate confidently in a regulatory environment where transport law is becoming increasingly complex and internationally interconnected.

Practice Description

Since its establishment, Inmar Legal has developed expertise in the field of maritime law and international transportation. Within this practice, the firm has successfully implemented a number of large projects, supported the business of Russian and foreign shipowners, and prepared several legislative initiative proposals, some of which have been reflected in federal legislation.

For example, Inmar Legal prepared an expert opinion on a package of amendments to the legislation regulating multiple crossings of the State Border of the Russian Federation by fishing fleet vessels. The firm’s proposals were fully taken into account in the adoption of Federal Law No. 504-FZ of December 31, 2014 “On Amendments to Article 9 of the Law of the Russian Federation ‘On the State Border of the Russian Federation’ and Article 6 of the Federal Law ‘On the Procedure for Exit from the Russian Federation and Entry into the Russian Federation’.”

The firm provides a full range of legal services to accompany cargo transportation by sea, road, and rail, including issues of carriage and freight forwarding, interaction with customs and regulatory authorities, contract drafting, and litigation support.

Experience in legislative work has enabled the firm’s team to develop a systematic approach to protecting clients’ interests: we consider any task not only through the lens of a specific dispute, but also in the context of industry regulatory trends. This is especially important in disputes with carriers, where the precise qualification of the parties’ obligations and issues related to violations of international transportation conditions are of key significance.

Our lawyers handle cases involving disputes over liability for damage or loss of cargo, refund of unreasonably charged tariffs, insurance claim issues, and conflicts with terminal operators. We also provide legal support on administrative liability and regulation of transportation of dangerous and special cargo categories. The firm participates in matters requiring international legal coordination — for example, in cross-border supplies and multimodal transport.

In such projects our team ensures interaction between Russian and foreign participants, prepares bilingual contracts, and analyzes applicable law. Today, the transport law practice at Inmar combines legislative participation experience, litigation defense, and contract expertise. We build long-term relationships with clients, helping them not only resolve disputes but also establish sustainable legal mechanisms for doing business in the transport-logistics sector.

Experience

Freight Forwarder — International Cargo Damage Claim

Represented a freight forwarder in a dispute arising from partial cargo damage during international transportation. The claimant alleged liability of the forwarder for losses sustained. Our team demonstrated the absence of a causal link between the client’s actions and the damage, relying on transport documentation, technical records, and expert analysis. The court dismissed the claim in full, allowing the client to avoid substantial financial exposure.

Logistics Operator — Delivery Delay Allegations

Advised and represented a logistics operator facing a damages claim for alleged late delivery under a freight forwarding arrangement. We established that transportation had been organized properly and that the penalties claimed were calculated incorrectly. The court rejected the claim, confirming the client’s compliance with its contractual obligations.

Cargo Owner — Railway Overweight Charges Dispute

Acted for a cargo owner in a dispute with a rail carrier over additional charges imposed after control weighing of a railcar. Our lawyers identified procedural violations and methodological inconsistencies in the weighing process. The charges were cancelled, and the client recovered previously debited amounts.

Cargo Owner — Container Damage at Port Terminal

Represented a cargo owner after an insurer denied indemnity for container damage, citing policy exclusions. We proved that the damage resulted from the fault of the terminal operator rather than an insured transport risk. As a result, the client recovered repair costs and related expenses from the responsible operator.

International Trading Company — Unlawful Cargo Retention in Port

Advised an international trading company whose containers were unlawfully withheld by a port agent pending payment of disputed fees. Our team obtained interim relief and conducted negotiations that led to the prompt release of the cargo. The client minimized operational downtime and recovered part of the incurred losses.

Freight Forwarder — Non-Payment for Freight Forwarding Services

Represented a freight forwarder in court proceedings against a customer that refused to pay for services rendered. By presenting comprehensive evidence of proper performance — including transport documentation, route records, and correspondence — we secured a judgment awarding full payment of the debt and reimbursement of legal costs.

Russian Transport Company — Multimodal Transport Delay

Acted for a Russian transport company that suffered losses due to delays in multimodal delivery caused by a foreign subcontractor’s failure to timely provide containers. We proved breach of obligations under the international freight forwarding contract and substantiated the application of Russian law. The court awarded recovery of storage costs and consequential losses.
